Affiliate Agreement

To be an authorized affiliate of TOM3C.COM, you agree to abide by the terms and conditions contained in this agreement.

Please read this agreement carefully before registering and using the TOM3C.COM service as an affiliate. By signing up for the TOM3C.COM affiliate program, you indicate your acceptance of this agreement and its terms and conditions.

How It Works

TOM3C.COM will provide our affiliates with unique tracking codes. These codes must be placed in the HTML of your website and when clicked on will direct the visitor to TOM3C.COM. If the user places an order from that computer or Internet connection, our automated system will track the sale and automatically credit your account.

Commissions

Commissions will be paid to affiliates based on successful referrals. A successful referral and sales, is defined as: non-fraudulent, complete the full payment and active for a period of thirty (30) days, not canceled or refund, customer who has paid in full using a unique credit card and has been directed to TOM3C.COM through your affiliate tracking link. Upon such cancellation of said commission, we will provide at our discretion any and all non-private information to show sufficient reason for cancellation.

Due to the high frequency of credit card fraud and cancellation rates, TOM3C.COM reserves the right to hold commissions for up to 60 days for verification. TOM3C.COM also reserves the right to cancel commission in the event that TOM3C.COM is unable to collect funds, the order is fraudulent, the order cancels and is refunded, or if TOM3C.COM learns that the commission was earned improperly. We do not allow self referrals and all self referral commissions will be removed. The minimum balance for a payout is RM100. Commissions that do not reach the RM100 minimum payout within 6 months are considered forfeit.

TOM3C.COM reserves the right to hold a reserve on payments in the event that TOM3C.COM identifies financial risk, chargeback risk, or an inability of the affiliate to reimburse TOM3C.COM for future chargeback costs. The reserve amount will be determined based on previous commissions and sales rates, risk analysis, and other factors. TOM3C.COM reserves the right to hold the reserve amount for up to 12 months and no longer.

Payments

Affiliates are responsible for making sure they are able to accept payments. Please ensure that your bank or PayPal account can accept payments from us.

Affiliates are responsible for ensuring that all payee information is up to date in the affiliate system. We are not responsible for lost/stolen payments. The affiliate is responsible for keeping all information up to date including postal and email addresses, name, payment information, tax information or any other personal information that will impact the ability to issue a valid commission payment. Failure to provide current information may result in forfeiture of any commissions due to you. Commissions that are left unclaimed or are returned for invalid or insufficient address information or for other reasons may be forfeited as well.

Affiliates are responsible for any and all fees, taxes, exchange rates, surcharges and other expenses incurred in order to receive their commissions. Please check with your local banking institution or PayPal to find out if any of these apply for your account.

Representation

You agree that you will not make any representations, promises, warranties or other statements about TOM3C.COM or the TOM3C.COM web site, products or policies other than as may be expressly approved in writing by TOM3C.COM or as other wise provided to you by TOM3C.COM for that purpose.

You also agree not to represent or promote your affiliate link or website as TOM3C.COM or the TOM3C.COM website. This includes, but is not limited to, redirects of your affiliate link, or reproducing TOM3C.COM website as your own.

Family Restriction

We are unable to credit affiliate accounts for sales from family members. This includes but is not limited to: spouse, sibling, parent, child, cousin, or any other direct or indirect relative.

Promotions, Specials, and Coupons

Affiliates may promote, endorse, and advertise any specials and promotions that are currently available on our main website page. Any referrals, or sales, generated through your affiliate link will not receive credit if combined or used in conjunction with coupons, promotions or specials offered, that are exclusive to individual affiliates and/or their websites.

Terms of the Agreement

The term of this agreement will begin upon acceptance of your affiliate program application, and will end when terminated by either involved party. You, and TOM3C.COM reserve the right at any time to cancel this relationship, with or without cause, by giving notice of termination. Once terminated, you will not be eligible to receive commissions for any referrals.

At the sole discretion of TOM3C.COM, any violation of these terms and policies can result in termination of the affiliate relationship and/or reversal of any commissions not yet paid out.

These Terms of Service May Change

These terms of service may change. We will post the changes here, and your continued use of the service means you accept the changes we have made.
